Liability Disclosure

The Ma’u:sh’ Hoye'to’ EMS Training Center, also referred to as Black Oak EMS training Center, in partnership with the Tuolumne Band of Me-Wuk Indians (TMTC), Black Oak Casino Resort (BOCR), and the Tuolumne Economic Development Authority (TEDA), is committed to providing high-quality emergency medical education and training in a safe learning environment.

Participation in EMS education and training involves inherent risks, including but not limited to physical exertion, lifting and moving patients or equipment, exposure to simulated or actual emergency environments, use of medical equipment, clinical and field training activities, and potential exposure to communicable diseases or other hazards commonly associated with emergency medical services.

By applying for, enrolling in, or participating in any program offered by the Ma’u:sh’ EMS Training Center, participants acknowledge that they understand these inherent risks and agree to follow all Training Center policies, safety procedures, instructor directions, and applicable federal, state, tribal, and clinical site requirements.

Participants are responsible for accurately disclosing any medical conditions, physical limitations, or other circumstances that may affect their ability to safely participate in training activities. The Training Center reserves the right to require appropriate medical clearance when necessary to ensure the safety of the participant and others and deny participants application if found to be unable to perform/participate in the essential class requirements.

In consideration for being permitted to voluntarily participate, the Ma’u:sh’ EMS Training Center, the Tuolumne Band of Me-Wuk Indians (TMTC), Black Oak Casino Resort (BOCR), the Tuolumne Economic Development Authority (TEDA), their officers, employees, instructors, volunteers, contractors, and affiliated clinical or field training partners shall not be liable for injuries, illnesses, death, property loss, or damages arising from participation in Training Center activities, whether known or unknown, inherent to EMS training and field operations.

Nothing in this disclosure waives, limits, nor any oral or written representation made by the Tribe or its agents, shall be construed as a waiver, limitation or modification of any sovereign immunity, legal rights, defenses, or protections possessed by the Tuolumne Band of Me-Wuk Indians, its governmental entities, enterprises, or affiliated organizations. The Tribe and its entities expressly retain sovereign immunity from suit.

Participants remain responsible for maintaining and providing if requested any required health insurance, personal property insurance, or other coverage applicable to their participation in Training Center activities.

Enrollment in or participation in a program constitutes acknowledgment that the participant has read, understood, and accepted this Liability Disclosure.
